Shuangling (Sunny) Shang is a Senior Associate based in the firm’s Ningbo Office, where she has been practicing since 2021.
Sunny was admitted to China Bar in 2015. She has started practicing intellectual property law ever since.
Sunny’s practice primarily focuses on litigating trademark and patent civil and administrative disputes. She has abundant experience in evidence gathering and legal research and is capable of untangling complex legal matters through in-depth case analysis. Sunny’s spectrum of experience also extends to Customs border protection. She handles a substantial number of Customs interceptions and follow-up proceedings and knows the ins and outs of the Customs practice. She has advised a dozen listed companies in their trade secret civil disputes and enforcement cases.
A list of Sunny’s recent work includes:
● Representing KYB in suing a trademark infringer in Fujian and in successfully persuading the court into accepting our argument in terms of the criteria for ascertaining the starting point of the statute of limitations for the civil litigation following Customs interception.
● Representing a local paper factory in suing trademark infringers in Shanghai and Henan, obtaining favorable court decision that the defendant’s registered trademark, which was altered in actual use, was similar to the plaintiff’s trademark, thus constituted trademark infringement.
● Representing WAHL in suing a trademark infringer in Ningbo, obtained cessation and damages of RMB 300,000 with a single picture of infringing products displayed on the defendant’s website.
● Representing a client in securing a favorable court decision against a design patent infringer in Ningbo, a case included in the“Top Ten Intellectual Property cases of Ningbo Court in 2018”.
● Advising SC Johnson in its global anti-counterfeiting program of “Overseas Seizure, China’s Accountability”, a case included in the“Top Ten Cases of Intellectual Property Protection in 2018-2019”by QBPC (Quality Brand Protection Committee of China Association of Enterprises with Foreign Investment).
● Representing a client in the Customs protection action involving patent infringement of segway, a case included in the“China Exemplary Customs Intellectual Property Rights Protection Case in 2018”released by the General Administration of Customs.
● Representing SC Johnson in winning a trademark administrative litigation involving invalidation disputes, where the client’s trademark was recognized as a well-known trademark by Beijing Intellectual Property Court.
● Representing Honda Motor in winning a retrial proceeding (HONDAKIT case) against the OEM manufacturers of infringing products before the China Supreme People’s Court (SPC), which affirmed that by using a mark through labelling or in other manners on the manufactured or processed goods, so long as such mark could serve as a source identifier of the said goods, the use is trademark use and constitutes trademark infringement. The case was selected as one of the Chinese Court’s Top 10 Intellectual Property Cases of 2019.
