Express n° 22 News: IP | Chinese Market Watchdog Ramps up Enforcement Against Unfair Competition

On 11th June 2020, China’s State Administration for Market Regulation (SAMR) issued the “Notice on Strengthening Anti-Unfair Competition Enforcement to Create an Environment of Fair Competition” (the Notice), urging local market regulatory departments to:
1) Investigate and punish trade secret theft;
2) Conduct anti-unfair competition enforcement in key sectors like consumer goods, epidemic prevention supplies, live-streaming platform, medicines and healthcare service;
3) Innovatively combat unfair competition, protect corporate IP and improve business environment;
4) Raise the public awareness of the Interim Provisions on Banning Unlawful Promotions; and
5) Launch proactive supervision in key industries such as E-commerce, catering and education to ensure the compliance with the Provisions.
