Wanhuida Cases Win Best Practice Award at Yinchuan CTF

On Saturday 6th July, 2019, the “Typical Trademark Cases Review and Analysis - Integration of Provisions of Trademark Right Granting and Affirmation in the Revision of Trademark Law” is held at the Yinchuan International Exhibition Center. Zang Baoqing, CTA Deputy Secretary General releases the winning cases of the “2018-2019 Best Practice Award of Trademark”.

 

A total of 174 cases have been appraised by a Case Review Board composed of experts from Courts, universities and trademark administrative departments. The “CARTELO CROCODILE PTE LTD v TRAB et al. trademark invalidation administrative proceeding” and “奥福格 trademark opposition case”, which are represented by Wanhuida Intellectual Property, are ranked among the 27 winning cases.

 

Zang Baoqing moderates the panel. Wang Yanfang, Chief Justice, Intellectual Property Tribunal, Supreme People’s Court, serves as commentator. The firm’s Partners Yang Mingming and Zhang Han make the podium to receive the awards.

 

“CARTELO CROCODILE PTE LTD v TRAB et al. trademark invalidation administrative proceeding” – The firm represents Lacoste in the invalidation proceeding and the subsequent administrative litigation initiated by CARTELO CROCODILE PTE LTD against its registered trademark “” in class 25, which went through the TRAB (Trademark Review and Adjudication Board) proceeding, first instance, second instance and retrial, obtained favourable retrial judgment, which decided to maintain the validity of the left facing crocodile device. The case is selected to be included in the SPC’s 50 Exemplary IPR Cases of the year.

 

奥福格 trademark opposition case” – The firm represents the INSTITUT NATIONAL DE L'ORIGINE ET DE LA QUALITE in initiating an opposition proceeding against the applied trademark “奥福格” (transliteration of AUVERGNE) designated to be used on the goods like “canned fish, pickled fruit; cheese” in Class 29, citing “BLEU D’AUVERGNE”, an appellation of origin for French cheese. The opposition was supported by the China Trademark Office (CTMO). The case is selected to be included in the “Exemplary Trademark Cases of 2018” released by the National Intellectual Property Administration.
