Wanhuida Cases Win Best Practice Award at Tangshan CTF

On Saturday September 1, 2018, the “Typical Trademark Cases Review and Analysis Panel – Regulation of Bad-faith Registration in the Amendment to the Trademark Law” is held. Zang Baoqing, CTA Deputy Secretary General releases the winning cases of the “2017-2018 Best Practice Award of Trademark”.

A total of 103 cases have been appraised by a Case Review Board composed of experts from Courts, universities and trademark administrative departments. The “Invalidation of Keemun GI certification trademark” and “Xinhua Dictionary trademark infringement & unfair competition case”, which are represented by Wanhuida, are ranked among the 26 winning cases.

Zhang Xiaojin, Presiding Judge, Second Tribunal, Beijing Intellectual Property Court and Dr. Yuan Zhenfu, Associate Professor of Shanghai University serve as commentators. The firm’s Partners Liu Bin and Yang Mingming make the podium to receive the awards.

Invalidation of Keemun GI certification trademark – The firm represents a major Keemun tea maker in invalidating the registration of Keemun Black Tea certification trademark, which erroneously designated Qimen County as the exclusive growing region of Keemun Black tea. The Court of Appeal found the registrant breached the good faith principle and upheld the invalidation decision. The case is selected as SPC’s 50 Exemplary IPR Cases in 2017.

Xinhua Dictionary trademark infringement & unfair competition case – The firm represents the Commercial Press in bringing a trademark infringement and unfair competition action against an infringer that publishes copycats of the client’s best-selling dictionary, obtained favorable court decision, judicial WKTM recognition of the client’s unregistered trademark, injunction and a damages of RMB 3.27 million. The case is selected as SPC’s Top 10 IPR Cases in 2017.
