Wanhuida Partner Speaks at 2019 Berkeley-Tsinghua Conference

On 22 October 2019, the 2nd Annual Berkeley-Tsinghua Conference on Transnational IP Litigation is held at Clark Kerr Conference Center, UC Berkeley Campus, Berkeley, California. The program, which is an outgrowth of collaboration between the Berkeley Law and Tsinghua Law, is produced by the Asia IP Project of the Berkeley Center for Law and Technology and is co-sponsored by the Berkeley Judicial Institute.

 

The goal of the program is to foster a deeper understanding among practitioners, judges and policy makers of the increasingly important role of cross-border litigation, especially for Chinese and American companies.

 

The conference examines critical issues in cross-border IP enforcement, with a focus on the United States and China, with topics including:

 Civil, administrative (Section 337) and criminal litigation;

Cases filed in the United States, China or third countries;
Sequencing and synchronizing cases;
The impact of trade sanctions;
The role of antitrust, including claims involving standards essential patents;
Managing regulatory approvals and patent litigation for new pharmaceutical products;
Challenges posed by on-line, long-arm, trade fair and other jurisdictional bases;
China’s new appellate IP courts;
The impact of changes in patentability in the US. 

 

In addition to these topics, issues such as choice of law, collecting evidence, hiring experts, and enforcement of judgments are discussed in the context of cross-border litigation.

 

Wanhuida Partner Feng (Janet) Zheng speaks on“Pre-litigation Considerations for Patent Litigation in China”at the panel“Planning a Litigation Strategy – Practitioners Perspectives”. The panel works through approaches to managing a multi-jurisdictional litigation program: costs, hiring local counsel, hiring experts, collecting evidence, settlement approaches, and other issues.

 

The firm’s partners Johnson Li and Lei Yongjian also attend the conference.
