On July 2, 2026, the “AIGC IP Risk & AI Creation Practice Session”, which is co-hosted by the Pudong New District Advertising Association and the China (Shanghai) Pilot Free Trade Zone Copyright Service Center, is held.
Zhang Xiaoquan, Associate, Wanhuida Intellectual Property, is invited to give a lecture on “Navigating Intellectual Property Risks Associated with AI-generated Content”. Xiaoquan first prepares the floor on the copyrightability assessment test and ownership determination of AI-generated content (AIGC). He then dives into the compliance risk surrounding training data, AIGC infringement assessment and the application of the safe harbor principle, from both the legislative and case law perspective.
Xiaoquan offers attendees practical compliance takeaways by highlighting the significance of distinguishing the usage scenarios of external and internal models. He cautions against the use of sensitive data like client information, financial statements, business plans, and personal information in training of external models. He also underlines the data leak risks by inducing generative artificial intelligence to extract data on population, financial, energy and geographical mapping. In concluding the lecture, Xiaoquan advises corporations engaged in AI creation to take notice of the prompt use, properly preserve the proof validating the creation process and build a moat to prevent external model from accessing confidential information.
